{"id":471835,"date":"2015-09-28T13:27:51","date_gmt":"2015-09-28T17:27:51","guid":{"rendered":"http:\/\/www.riverbendadvisors.com\/blog\/?p=471835"},"modified":"2015-09-28T16:42:58","modified_gmt":"2015-09-28T20:42:58","slug":"should-sustainable-investors-have-seen-the-vw-disaster-coming","status":"publish","type":"post","link":"https:\/\/www.riverbendadvisors.com\/blog\/2015\/09\/should-sustainable-investors-have-seen-the-vw-disaster-coming\/","title":{"rendered":"Should sustainable investors have seen the VW disaster coming?"},"content":{"rendered":"<p>There is an understandable, but misleading, narrative circulating around the Volkswagen emissions deception disaster &#8211; that the primary question is whether sustainable investors could and should have seen this coming and warned everyone.<\/p>\n<figure id=\"attachment_471889\" aria-describedby=\"caption-attachment-471889\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.riverbendadvisors.com\/blog\/wp-content\/uploads\/2015\/09\/800px-Parking_lot_at_HAA_Kobe.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-471889 size-medium\" src=\"http:\/\/www.riverbendadvisors.com\/blog\/wp-content\/uploads\/2015\/09\/800px-Parking_lot_at_HAA_Kobe-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.riverbendadvisors.com\/blog\/wp-content\/uploads\/2015\/09\/800px-Parking_lot_at_HAA_Kobe-300x200.jpg 300w, https:\/\/www.riverbendadvisors.com\/blog\/wp-content\/uploads\/2015\/09\/800px-Parking_lot_at_HAA_Kobe.jpg 800w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-471889\" class=\"wp-caption-text\"><span style=\"font-size: 75%;\"><a target=\"_blank\">Photo<\/a> by Laitr Keiows \/ <a>Creative Commons 4.0<\/a><\/span><\/figcaption><\/figure>\n<p>A reader poll in the daily CFA Institute Financial Newsbrief has 81% of respondents saying that analysts can not &#8220;anticipate (the) risk of such losses through analysis of a company&#8217;s governance and internal controls&#8221;.<\/p>\n<p>On the other side, Usman Hayat of the CFA Institute makes the case in the <a href=\"https:\/\/blogs.cfainstitute.org\/investor\/2015\/09\/24\/volkswagen-disaster-could-analysts-see-this-coming-2\/\" target=\"_blank\">Enterprising Investor blog<\/a> that the 12% who responded &#8220;yes&#8221; to the poll can legitimately point to numerous publicly-available indications of governance issues at Volkswagen dating to the 1990&#8217;s, with several prominent &#8211; and embarrassing &#8211; examples in recent years.<\/p>\n<p>Hayat makes the important point that <b class=\"c\">the commutative law does not apply here<\/b>. There is indeed very clear evidence that failures of corporate governance uncovered in ESG analysis do indicate a higher subsequent risk of bad outcomes &#8211; for the corporation, its shareholders and society. But it doesn&#8217;t necessary follow that every such bad outcome should have been predicted. The increased risk is what should be noted and acted on. The question is how? Are we looking for a needle in a haystack? Not necessarily.<\/p>\n<p>What has not been discussed in terms of ESG analysis in the Volkswagen case is the importance of <b class=\"c\">industry risk factors<\/b>. Cheating on emissions testing has a <a href=\"http:\/\/www.nytimes.com\/2015\/09\/25\/business\/international\/volkswagen-emissions-pollution-regulations.html\" target=\"_blank\">long and sad history<\/a> &#8211; from Ford, Chrysler and VW in the early 1970&#8217;s, to GM&#8217;s Cadillac division in 1995, to a $1 billion EPA settlement with the long-haul trucking industry in 1998. History indicates that vehicle emissions should have been flagged much earlier as a material risk factor for vehicle manufacturers.<\/p>\n<p>It is only with the emergence of SASB, the <a href=\"http:\/\/www.sasb.org\" target=\"_blank\">Sustainability Accounting Standards Board<\/a>, that there has been a systematic effort to identify &#8211; and focus on &#8211; the material risk factors for specific industries.  <b class=\"c\">It will be that increased focus at identifying and following material, industry-specific risk factors that will enable investors to reduce the number of &#8220;surprises&#8221; like Volkswagen&#8217;s emissions cheating.<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>There is an understandable, but misleading, narrative circulating around the Volkswagen emissions deception disaster &#8211; that the primary question is whether sustainable investors could and should have seen this coming and warned everyone.
